This miscellaneous petition has been preferred to suspend the sentence imposed on the petitioner by judgment dated 07.07.2022 in Special Sessions Case No.277 of 2019, on the file of the Sessions Special Court for exclusive Trial of Cases under POCSO Act, Salem and enlarge the petitioner on bail.
2.Heard the learned counsel on either side and perused the materials available on record.
3. Since the petitioner was found guilty of the offence under Sections 3 and 4 of the POCSO Act, and Section 9 of the Child Marriage Act, this Court is inclined to take up the main appeal itself ''for final disposal'' soon after receipt of the entire records, and hence, this Miscellaneous Petition is dismissed.
4. It is revealed that the records have been called for from the Court below on 30.08.2022, however, typed-set of papers was not made ready. The Registry is directed to call for the records from the Court below, if not received and thereafter, prepare typed set of papers and serve copies on the learned counsel on either side well in advance, as per the criminal rules of practice.
