ORDER

This Criminal Revision Case has been filed challenging the order dated 22.05.2025 passed in CMP No.299 of 2025 by the Additional District Munsif cum Judicial Magistrate Court, Ambur, Tirupattur District.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate Crl.Side appearing for the respondents. Perused the materials available on record.

3. The third respondent lodged a complaint alleging that she was in a live-in relationship with one Gowtham. It is alleged that though the said Gowtham had already married another woman, he continued to live with the third respondent. Therefore, the third respondent approached the petitioner in this regard, and for which the said Gowtham agreed to pay a sum of Rs.15,00,000/- as compensation to the third respondent. Thereafter, the said Gowtham paid a sum of Rs.10,00,000/- to the third respondent and the balance amount of Rs.5,00,000/- to the petitioner's account. However, the petitioner failed to return the said amount to the third respondent. Hence, the third respondent lodged a 2/4

complaint. However, the second respondent did not take any action against the petitioner and as such, the third respondent approached the Magistrate under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Accordingly, the learned Magistrate rightly directed the second respondent to register a FIR and proceed with the investigation.

In view of the above, this Court finds no infirmity or illegality in the order dated 22.05.2025 passed in CMP No.299 of 2025 on the file of the Additional District Munsif cum Judicial Magistrate Court, Ambur, Tirupattur District. Accordingly, this Criminal Revision Case stands dismissed. It is made clear that if the petitioner settles the issue with the third respondent, the second respondent is directed to dispose of the complaint in accordance with law. Consequently, connected miscellaneous petition is closed.
