A.No.4170 of 2021 has been filed by the applicant/plaintiff seeking to condone the delay of 3 days in filing the application for setting aside the abatement.

A.No.4171 of 2021 has been filed seeking to set aside the abatement caused due to the death of the second defendant in C.S.No.416 of 2018.

A.No.4172 of 2021 has been filed seeking to implead the legal heirs of the deceased second defendant in C.S.No.416 of 2018. 4.

The learned counsels appearing for the respective respondents have not raised any serious objection for allowing these applications. 5.

Accordingly, these applications are allowed as prayed for. The applicant / plaintiff is directed to carry out the amendment. 7.

The learned counsel for the plaintiff would submit that the mater can be referred to Mediation. However, the learned counsel for the defendants seeks time to get instructions with regard to the same. 8.

The Registry is directed to post the matter before this Court for hearing on 09.12.2021, after the amendment is carried out, as directed by this Court today.
