PRAYER: The Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to direct the 2nd respondent herein not to harass the petitioners in any manner except by due process of law pursuant to the representation dated 26.09.2021 given to the respondents.

This Criminal Original Petition has been filed to direct the 2nd respondent herein not to harass the petitioners in any manner except by due process of law pursuant to the representation dated 26.09.2021 given to the respondents.

2. When the matter is taken up for hearing, Mr.V.Meganathan, learned Government Advocate (crl.side) would submit that on the complaint given by one Nivethabegam, a case in Crime No.966 of 2020 has been registered for the offences under Section 457 and 380 of IPC. The first petitioner is the mother and the second petitioner is the sister of the accused in the above crime number. The accused was arrested and during enquiry he has stated that he had handed over the stolen jewels to his mother https://hcservices.ecourts.gov.in/hcservices/

and sister, based on the statement the respondent police has called them for enquiry. The jewels were not recovered from the accused.

3.Under such circumstances, once the regular FIR has been registered, the question of "Not to harass" will not arise. Any direction issued by this Court at this stage will amount to interfering with the investigation conducted by the respondent police.

4.This Criminal Original Petition has been closed, accordingly.
