ORDER
This Writ Petition has been filed for a direction, directing the second respondent to consider the representation submitted by the petitioner dated 16.04.2024 seeking restoration of his increment on expiry of his currency of punishment.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner was appointed as Pharmacists and now she is working under the third respondent. While being so, the petitioner was served with a charge memo dated 06.09.2012 under Rule 17(a) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules. After conducting enquiry, the petitioner was imposed with a punishment of stoppage of increment for one year without cumulative effect. Once
again, the petitioner was served with a charge memo dated 10.10.2023 under Rule 17(b) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules and the enquiry is pending. Further, earlier currency of punishment was over and as such the petitioner submitted a representation to restore his increment.
4. In view of the above, the second respondent is directed to consider the request made by the petitioner and pass orders on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
5. With the above direction, this writ petition stands disposed of. No costs.
