Prayer: Writ Petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents to consider the representation of the petitioners dated 27.03.2023 and restore the License issued to the petitioners for running of a retail outlet for the sale and distribution of petroleum products supplied by the respondents in S.F.No.89/1C3 in Karamudi Village, Mettupalayam Taluk, Coimbatore District.

ORDER

The petitioners are the partners of the firm M/s.Srevalsa Agency. They were granted dealership license by the first respondent BPCL. Earlier, due to strong differences between them, BPCL issued a holiday time for the partners to resolve their dispute and since they showed little anxiety to resolve the same, the BPCL was constrained to terminate the license on 13.04.2022. Now, the partners have resolved their differences and now want the BPCL to consider awarding them the license earlier given and have also given a representation dated 27.03.2023 to the second respondent to that effect.

Mr.M.Vijayan, learned counsel takes notice for the respondents 1 to 4. 3.The second respondent is now required to take a decision on the representation of the petitioners and if necessary, to give both the petitioners an opportunity of being heard, and dispose of the representation within a period of six (6) weeks from the date of receipt of a copy of this order.

4.The Writ Petition is disposed of accordingly. No costs. Consequently, the connected miscellaneous petitions are closed. 14.07.2023 Index : Yes/No Internet : Yes/No Tsg 3/4
