Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 2nd Respondent to pass orders on the appeal petition dated 18.05.2026 filed by the petitioner to cancel the patta in P.No.103 dated 12.03.2026 issued in favour of the Respondents 4 and 5 and in the name of deceased Late.Thiru. Aiyyavu by the 3rd respondent in respect of the house property in Old S.No.173/1 New S.No.374/18 to the extent of 0.0.65.00 Hectare situated at Tharamangalam Village, Omalur Taluk, Salem District and include the name of the petitioner and other legal heirs in the said patta For Petitioner(s):

ORDER

This writ petition has been filed to direct the respondents to consider the petitioner's appeal dated 18.05.2026.

2. Ms.Inthu Karunakaran, learned Government's counsel, takes notice on behalf of the respondents 1 to 3.

3. By consent of the parties, the main petition is taken up for disposal in the stage of admission itself.

4. The learned counsel for the petitioner would submit that in this case, the petitioner had filed an appeal dated 18.05.2026 for cancellation of patta issued on 12.03.2026 in favour of the respondents 4 and 5 and for including the name of the petitioner and other legal heirs in the same. However, the said representation was not at all considered by the respondents till date.

5. In reply, the learned Government's counsel appearing for the respondents would submit that the petitioner's appeal will be disposed of within a period of 12 weeks. Hence, she requests this Court to pass appropriate orders.

6. Heard the learned counsel for the petitioner and the respondents and also perused the entire materials available on record.

7. In view of the above, though this petition is filed for larger relief, this Court only directs the 2nd respondent to dispose of the appeal dated 18.05.2026 filed by the petitioner, on merits and in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order.

8. As far as the other relief, viz., direction for cancellation of patta issued in favour of the respondents 4 and 5 and for including the name of the petitioner and other legal heirs in the same, is concerned, it is beyond the jurisdiction of

this Court and it is up to the 2nd respondent to pass appropriate orders after conducting thorough enquiry.
