Respondents Prayer : Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of habeas corpus directing the respondents to produce the corpus of Buvaneshwari D/o Anuradha, aged about 23 years before this Court and set her at liberty and consequently order to take her custody by the petitioner herein.

ORDER

(Order of the Court was made by S.NAGAMUTHU, J.) The petitioner is the grand mother of one Bhuvaneshwari aged 23 years. Bhuvaneshwari is a B.Com graduate. According to the petitioner, she has been found missing from 26.10.2015. Since she has not been secured by the 2nd respondent, she has come up with this Habeas Corpus Petition.

2. Today, when the Habeas Corpus Petition was taken up, the 2nd respondent produced the detenue. On enquiry, she told us that on her own volition on 28.10.2015, she went out of her parental home and married one Marimuthu. She has further stated that even before her marriage, on account of the sexual intercourse, she had with one Marimuthu, a child was born to her https://hcservices.ecourts.gov.in/hcservices/

on 14.1.2016. Now, she is living with Marimuthu, she submitted.

3. The petitioner and also the mother of the detenue made appearance. They said that since the detenue has married one Marimuthu, they do not want to have any relationship with her. The said statement is recorded.

4. In view of the above admitted fact, since there is no illegal detention, this Habeas Corpus Petition is dismissed leaving it open for the detenue to choose her own way of life.
