Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents to survey the property in the Survey No.74/4C1 of Murugamangalam Village, Chetpet Taluk, Thiruvannamalai District and sub divide the same as per the settlement deed dated 6.6.2022 which was registered as Doc. No.1933/2022 in the office of the Sub Registrar, Chetpet within a stipulated period of time as fixed by the Hon'ble Court. 1/6

ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. 2.The present writ petition is filed praying for a Writ of Mandamus to direct the respondents to survey the property comprised in S.No.74/4C1, measuring an extent of 0.37 acres, situated at Murugamangalam Village, Chetpet Taluk, Thiruvannamalai District and to sub divide the subject property.

3.It is submitted by the learned counsel for the petitioner that after purchase of the above mentioned property, petitioner executed a Settlement Deed in favour of his mother vide Settlement Deed dated 06.06.2022, in respect of property comprised in S.No.74/4C1, measuring an extent of 0.37 acres out of 0.61 acres and remaining 0.24 acres was retained by the petitioner and petitioner has been in continuous possession of the same.

4.It is further submitted by the learned counsel for petitioner that petitioner applied for survey the property on 16.10.2024 to the respondents. Petitioner also applied for sub division of subject property on 02.04.2025 and had also paid necessary fees for the same. However, the survey and sub division have not been carried out by the respondents till date. Hence, the present writ petition has been filed before this Court. 5.Learned Additional Government Pleader for the respondents would submit that they would conduct survey and sub divide the subject property within a time frame to be fixed by this Court, which was agreed to by the learned counsel for the petitioner. 6.

In view thereof, the writ petition stands disposed of with a direction to the respondents to conduct survey and sub divide the subject property, after putting the petitioner, adjacent land owners and other interested party including rival claimants, if any, on notice, within a period of 8 weeks from the date of receipt of a copy of this order.
