This Writ Petition has been filed challenging the impugned order dated 23.04.2025 of the 2nd respondent, rejecting the representation of the petitioner seeking grant of 28 days ordinary leave to her husband / life convict, on the ground that the life convict has not surrendered, after availing the three days emergency leave on 04.04.2011. 2.The learned counsel for the petitioner submitted that to make medical arrangements for the petitioner as well as to perform a marriage for the son of life convict, the petitioner has sought for 28 days ordinary leave to her husband / life convict. He further submitted that this court has earlier granted 7 days ordinary leave one year back. He further submitted that the life convict has undergone more than 13 years of imprisonment and therefore, sought for grant of ordinary leave.
3.The learned Additional Public Prosecutor has produced the particulars of the life convict dated 20.08.2025 and the report of the Probation Officer dated 13.08.2025. The Probation Officer in his report has stated that the reasons assigned in the representation seeking grant of leave is not genuine and has not recommended for grant of 2/6
leave to the life convict.
4.Though the Probation Officer has not recommended to grant leave to the life convict, we have taken into consideration that the last leave availed by the life convict was one year back, as well as the reasons assigned in the affidavit filed in support of this petition, we are inclined to grant 20 days of ordinary leave to the petitioner's husband/life convict, by invoking our powers under Article 226 of the Constitution of India.
5.Accordingly, the impugned order passed by the 2nd respondent No.Nil dated 23.04.2025, is hereby quashed. Consequently there shall be a direction to the respondents herein, to grant 20 days ordinary leave "without escort" to the petitioner's husband / life convict namely Elumalai, son of Ponnusamy, aged 61 years, Ct.No.2239, (PID 37615), Life Convict, now confined in the Central Prison-1, Puzhal, Chennai - 66, commencing from 30.08.2025 to 18.09.2025, with a condition that the life convict shall report before the jurisdictional Police i.e. Perumbakkam Police Station, Chennai, daily at 10.30 A.M. After expiry of the Ordinary Leave, the life convict shall surrender before the Jail Authority on 18.09.2025 before 05.30 P.M. The life convict shall utilize the leave only for the purpose for which it has been granted and shall not indulge in any other activities. 6.With the above direction, the Petition stands allowed. 3/6
Consequently, the connected miscellaneous petition is closed. No costs.
