Learned counsel for the plaintiff submitted that settlement was arrived at between the parties and the joint memo of compromise was also filed in the connected C.S.No.396 of 2012 and in view of the settlement and compromise memo filed, he is not pressing this T.O.S. He has also made an endorsement to that effect.

2. In view of the submission and endorsement made by the learned counsel for the plaintiff, this Testmentary Original Suit is dismissed as not pressed. No costs.
