This Miscellaneous Petition has been filed to modify the condition imposed by this Court in Crl.O.P.No.13586 of 2024 vide order dated 20.06.2024.

The learned counsel for the petitioner would submit that this Court while granting interim anticipatory bail to the petitioner in Crl.O.P.No.13586 of 2024 dated 20.06.2024, had directed the petitioner to deposit a sum of Rs.7 lakhs to the credit of crime number. Since the petitioner is has no source of income, she could not comply with the said condition. Hence, the present petition is filed seeking to modify the said condition.

3. The learned Government Advocate (Crl. Side) objected to modify the said condition stating that this is the second application for anticipatory bail. In the earlier application in Crl.O.P.No.13254 of 2023, this Court by considering the undertaking given by the petitioner and her husband that they are ready to deposit a sum of Rs.7 lakhs to the credit of crime number, had granted anticipatory to them vide order dated 20.06.2023. However, the same was not complied by them. Thereafter, the petitioner filed the present Page No.1/3

petition in Crl.O.P.No.13586 of 2024 seeking anticipatory bail in which, this Court had granted interim anticipatory bail to the petitioner on condition to deposit a sum of Rs.7 lakhs vide order dated 20.06.2024. Instead of complying with the same, the petitioner has filed the present petition seeking modification of the said condition. He would submit that it is a case of job racketing wherein, the petitioner along with her husband has cheated the defacto complainant to the tune of Rs.15,80,000/-.

In view of the submissions made by the learned counsel on either side, the said condition is modified and the petitioner is directed to deposit a sum of Rs.6,00,000/- (Rupees Six Lakhs Only) to the credit of crime number instead of Rs.7 lakhs , within a period of two weeks from the date of receipt of a copy of this order. The other conditions shall remain intact.
