ORDER

Mr.L.S.M.Hasan Fizal, learned Government Advocate takes notice on behalf of the respondents.

2.Already an order has been passed by this Court on 21.09.2021 in W.P.No.17787 of 2021. The said order reads as under:

"The petitioner applied for the post of

Assistant pursuant to notification issued on 13.03.2020 by the 2nd respondent.

2. It is the case of the petitioner that out of 75 vacancies announced 66 vacancies have been filed. It is also the case of the petitioner that the petitioner was at Sl.No.4 in the waiting list. It is therefore submitted that since there are almost 9 vacancies, the respondents may be directed to fill up the vacancies in the order of merit. It is submitted that if the petitioner is found eligible, he may be directed to be appointed.

3. The learned counsel for the respondents submits that the remaining vacancies will be filled. It is submitted that if the petitioner is otherwise found eligible to be appointed and appropriate orders will be passed by the 2nd respondent to appoint the petitioner.

4. Recording the same, this writ petition is disposed by directing the 2nd respondent to fill up the vacancies /operate the waiting list and if the petitioner is otherwise found eligible, appointment order may be issued to the petitioner. This exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed."

3.Since the petitioner has reserve list at Sl.No.6, the respondents may consider whether the petitioner is eligible to be appointed against the pending vacancies, this writ petition stands allowed in terms of the above observations by directing the respondents to consider the case of the petitioner and pass appropriate orders within a period of six weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
