ORDER
This Criminal Original Petition has been filed seeking a direction to the respondent Police to complete the investigation and file the final report in Cr.No.111 of 2025, within the time stipulated by this Honorable Court.
2. It is the case of the petitioner that his eldest son, after attending a function, returned home. At that time, the accused abused him with filthy language. When the same was questioned by the de facto complainant and his younger son, they were attacked with a wooden log causing bleeding injuries. Hence, an FIR was registered against the accused in Crime No.111 of 2025 for the offences under Sections 296(b), 115(2), 118(1), and 351(3).
3. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that there is a case and counter case in Crime No.114 of 2025 for identical offences.
4. It is evident that the present case is a case and counter case and it cannot be considered independently. Both the cases must be investigated together in a holistic manner. It is the duty of the investigation officer to consider both the cases simultaneously and thereafter take appropriate action as per the judgment of the Full Bench of this Court in the case of Balaji and others
vs. State of Tamil Nadu and others reported in 2024 (5) CTC 1 as well as the Police Standing Order No.566. In any event, final reports are to be filed in both cases without delay.
