..Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the respondents to fill up the existing vacancies for the post of Civil Judge pursuant to the Notification of the fourth respondent in No.12/2023 dated 01.06.2023 by duly operating the Reserve/Wait List in strict consonance with section 3(u) of Act, 14/2016 and to appoint the petitioner in any one of the said vacancies forthwith thereto.

ORDER

(Made by S.M.Subramaniam J.) The writ of mandamus has been instituted to direct the respondents to fill up the existing vacancies for the post of Civil Judge pursuant to the Notification of the fourth respondent in No.12/2023 dated 01.06.2023 by duly operating the Reserve/Wait List in strict consonance with section 3(u) of Act, 14/2016 and to appoint the petitioner in any one of the said vacancies.

2. Filling up of vacancies to the post of Civil Judge is the prerogative of an employer. A candidate participated in the process of selection cannot seek such a direction, more so, in the present case, the process of selection became final and selected candidates were appointed and serving the judicial department for the past about two years. Regarding the five vacancies, which is the subject matter of the present writ petition, the Tamil Nadu Public Service Commission communicated a letter dated 19.03.2024 to the Registrar (Recruitment), High Court of Madras, which reads as under: "I am directed to invite kind attention in the reference cited and to inform that, out of 245 vacancies notified to the post of Civil Judge in the Tamil Nadu State Judicial Service, totally 240 vacancies have been filled and remaining five vacancies are unfilled due to paucity of candidates in the respective categories.
