This petition is filed under Section 438 Cr.P.C., to enlarge the petitioner on bail in the event of his arrest in Crime No. Not known/2023, on the file of the respondent police.

2. When the matter is taken up, the learned Government Advocate (Crl.Side) submitted that bailable warrant was issued against the petitioner in CS\38171\2021 by the VIIth Metropolitan Magistrate Court, Calcutta, in a cheque dishonour case filed under Section 138 of N.I.Act.

3.In the circumstances stated, this Court directs the petitioner to approach the learned VIIth Metropolitan Magistrate, Calcutta, with a petition to surrender and recall of bailable warrant. On such filing of the petition, the learned VIIth Metropolitan Magistrate Court, Calcutta, is directed to consider the petition on merits and in accordance with law and dispose the petition on the same date.
