Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the respondents to provide job assistance on compassionate ground.

O R D E R

The prayer sought for in this Writ Petition is to direct the respondents to provide job assistance on compassionate ground.

2. The case of the petitioner is that her husband died while in service on 15.08.2012 leaving behind the petitioner and his three daughters. Thereafter, the petitioner applied for the job under Compassionate Appointment to her 3rd daughter, namely, Buvaneswari, with all necessary documents including her educational certificate and the same was rejected by the 2nd respondent on sole ground that she was married on the date of application. Aggrieved by the said rejection, the petitioner filed Writ Petition in W.P.No.5941 of 2016. This Court by order dated 18.02.2016 dismissed the Writ Petition. As against the said order of dismissal, the petitioner filed an appeal in W.A.No.573 of 2016 and the Hon'ble Division Bench of this Court by Judgment dated 22.07.2016, set aside the order passed by the learned Single Judge and directed the respondents to pass orders in accordance with the observation made in the Writ Appeal. https://hcservices.ecourts.gov.in/hcservices/

3. Thereafter, the application made by the petitioner was rejected on the ground that the application was made with a delay of 70 days. Consequently, the petitioner filed a Contempt Petition in Cont.P.No.546 of 2017. On 04.01.2018, the said Contempt Petition was closed by issuing direction to the respondents to re-consider the case of the petitioner and pass appropriate orders.

Thereafter, the petitioner made a representation on 13.04.2018 to the 1st respondent. However, till date the said representation was not considered. Therefore, the present Writ Petition has been filed.

4. The learned counsel appearing for the petitioner would submit that it would be suffice to issue direction to the respondents to consider and dispose of the representation dated 13.04.2018 in accordance with law.

5. Considering the facts and circumstances of the case and the limited request made by the learned counsel for the petitioner, I am inclined to issue direction to the respondents to dispose of the representation dated 13.04.2018, if not disposed already within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the above direction, the Writ Petition is disposed of. No costs.
