ORDER
By the consent of both parties, the present writ petition is taken up for final disposal at the admission stage itself.
2. The present writ petition has been filed praying for a writ of mandamus direct the second respondent to regularize the vacant land, measuring to an extent of 5.45 cents, comprised in Plot No.4, Survey No.418/2 in Venkateshwara Nagar, 3rd Main Road, situated in 137, Velachery Village, Mambalam-Guindy Taluk, Chennai District in terms of G.O.Ms.No.565 dated 26.09.2008.
3. The petitioners would submit that they are the absolute owners of the subject property. The petitioners intended to process and develop a house in the said property. It was then the petitioners learned that the above land had been declared as surplus land under the Urban Land (Ceiling and Regulation) Act, 1976. Page No.2 of 6
4. The petitioner would then submit that the Government had issued a Government Order in G.O.Ms.No.565 dated 26.09.2008 to regularize certain classes of lands which have been declared as surplus lands under the Urban Land (Ceiling and Regulation) Act, 1976.
5. Mr.A.Selvendran, learned counsel for the respondent would submit that the above Government Order comes with strings of conditions attached to it. However, the representation of the petitioner would be examined in light of G.O.Ms.No.565 dated 26.09.2008 and appropriate orders, on merits and in terms of G.O.Ms.No.565 dated 26.09.2008, would be passed after hearing the petitioners and any other interested parties within a period of eight weeks from the date of receipt of the uploaded copy of the order. The same is accepted to by the learned counsel for the petitioners.
6. Recording the submissions made by the learned Special Government Pleader, the present writ petition stands disposed of. It is made clear that this Court has not expressed any views with Page No.3 of 6
regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law. There shall be no order as to costs.
