Defendants Prayer: Civil Suit has been filed under Order IV Rule 1 of the High Court Original Side Rules read with Order VII, Rule 1 of the Code of Civil Procedure, 1908 to pass a judgment and decree: a)directing the first defendant to pay a sum of Rs.3,53,88,300/- (Rupees Three Crores Fifty Three Lakhs Eighty Eight Thousand and Three Hundred only) to the plaintiff and to pay further interest on the principal sum of Rs.2,47,12,500/- (Rupees Two Crores Forty Seven Lakhs Twelve Thousand and Five Hundred only) at the rate of 18% from the date of decree till realisation;

b)for costs of the suit.

J U D G M E N T

The parties have arrived at a settlement out of the Court. They have also entered into a Memorandum of Compromise dated 23.03.2024. The said Memorandum of Compromise is also placed on record. 2.Learned counsel for the plaintiff has made an endorsement in the Court bundle seeking permission of this Court to withdraw the suit on the ground that the parties have settled the matter out of the Court in terms of the Memorandum of Compromise.

3.After recording the Memorandum of Compromise, which has been entered into between the parties out of the Court, this Court is dismissing the suit as settled out of the Court. 4.Registry is directed to re-fund the full Court Fees to the plaintiff. 27.03.2024 vga C.S.
