Application No.5028 of 2019 in C.S.Diary No.90827 of 2019 KRISHNAN RAMASAMY, J., The above Application has been filed seeking to grant leave to the applicant to institute the present suit in this Court against the first respondent/defendant.

2. The learned counsel for applicant submitted that the entire cause of action of the suit arose at Chennai, which is well within the jurisdiction of this Court. He further submitted that the registered office of the first respondent is outside the jurisdiction of this Court and therefore, the applicant has filed the above Application for the relief stated supra.

3. Heard the learned counsel for applicant.

4. After a perusal of the affidavit filed in support of the Application, this Court found that the entire cause of action has arisen at Chennai, as the public auction was conducted by the second defendant at its Office at T.Nagar, Chennai. The second defendant being an Authorized Officer, received the bid at Chennai, and all other correspondences made between the plaintiff and the second defendant is at Chennai. Therefore, it is seen that entire cause of action has arisen at Chennai and the first defendant has been impleaded as formal party to the suit, as they are the Head Office of the second defendant. Hence, this Application is ordered as prayed for.

5. Registry is directed to number the suit, if it is otherwise in order and post the same for hearing.
