Naveen Balaji S/o.Nagarajan ..Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India, pleased to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned Non-Traceable Certificate dated 20.06.2023 issued by the sixth respondent herein in favour of the ninth respondent and quash the same and consequently direct the respondents 1 to 5 to take action against the ninth respondent.

This Writ Petition has been filed challenging the proceedings of the sixth respondent dated 20.06.2023 issued in favour of the ninth respondent wherein entries were made in the general diary to the effect that certain original documents pertaining to the property are non-traceable.

2. Heard Mr.D.Alexis Sudhakar, learned counsel for petitioner and Mr.K.S.Mohandoss, learned Public Prosecutor (Puducherry) appearing for respondents 1 to 8.

3. Learned Public Prosecutor (Puducherry) appearing on behalf of respondents 1 to 8 submitted that initially after the complaint was received from the ninth respondent to the effect that certain original documents are missing with respect to subject property, an entry was made in the general diary to the effect that necessary action will be taken to trace out the original documents. In the course of enquiry, it was found that all the original documents remain with the petitioner and hence, the sixth respondent did not issue any non-traceable certificate to the ninth respondent. That apart, necessary action has also been taken by the sixth 3/6

respondent to reverse the earlier entry made in the general diary on 20.06.2023 in this regard.

In the light of the specific stand taken by learned Public Prosecutor (Puducherry), the grievance of the petitioner has been redressed and it is left open to the sixth respondent to make necessary entry in the general diary by reversing the earlier entry made on 20.06.2023. This process shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order. This Writ Petition is disposed of in the above terms. No costs.
