Respondents Prayer: The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus to direct the second respondent herein to assess the Palm Kernel Cakes imported under cover of Bill of Landing No.1356A00023 dated 13.05.2016 and Invoice No.MH/TRD/01/2016 dated 05.05.2016 by the petitioner herein by extending the benefit of duty exemption in terms of Customs Notification No.12/2014, dated 11.07.2014, as amended.

The learned counsel appearing for the petitioner submitted that he may be permitted to withdraw the Writ Petition, since the petitioner has now come to know that the benefit of exemption is not available. He has also made an endorsement to the said effect.
