Mr. C.R. Malarvannan Counsel For Government Of Tamil Nadu (Criminal Side) Order (Order of the Court was made by Dr.Anita Sumanth J.) The petitioner, mother of one Sureshbabu (convict), presently confined in Central Prison, Vellore, has filed this Writ Petition challenging order dated 04.06.2026 only to the extent to which it grants leave to the convict with escort.
2. The petitioner is aggrieved solely by the imposition of condition relating to the escort. Mr.C.R.Malarvannan, learned counsel for the Government of Tamil Nadu (Criminal Side), who accepts notice for the respondents, on instructions, does not seriously object to the removal of the condition of providing escort for the reason that the convict has availed leave earlier and this is not the first time that he is seeking leave. However, he requests that the convict may be asked to report before the jurisdictional police station every day in order to allay the apprehension of threat to his life and his family.
3. Accordingly, impugned order dated 04.06.2026, to the extent to which an escort has been provided, is set aside and ordinary leave of 28 days without escort is granted, though on the following conditions:
(i)The respondents are directed to release the convict viz., Sureshbabu, S/o.Selvaraj, aged about 38 years, confined at Central Prison, Vellore, on ordinary leave for a period of twenty eight (28) days without escort i.e., from 15.06.2026 to 12.07.2026.
(ii)The convict shall be released on 15.06.2026 at 10.00 A.M. and is directed to surrender before the Superintendent of Prisons, Central Prison, Vellore, on 13.07.2026 before 10.00 A.M.
(iii)The convict shall report before the Vellore North Police Station, Vellore, everyday at 10.30 A.M, during the period of leave. (iv)During the leave period, the Convict Prisoner shall abide by all the conditions prescribed in the Jail Manual.
