ORDER : The Court Made the following order :- The petitioners, who apprehend arrest for the alleged offence under Section 399 of IPC in Cr.No.313 of 2021, seeks anticipatory bail.
2.The case of the prosecution is that when the law enforcing agency were in regular vehicle check up, the petitioners were found with some dangerous weapons like knife and sword and found that the petitioners were preparing themselves to commit dacoity. Hence, the law enforcing agency registered a case against the petitioners. 3.The learned counsel appearing for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submits that the allegation against the petitioners is that they were prepared to commit dacoity. Hence he prays for grant of anticipatory bail to the petitioners.
4.The learned Government Advocate (Crl.Side) submitted that there are three previous cases pending against the petitioner/A-5, out of which, two are murder cases and there are seven previous cases https://hcservices.ecourts.gov.in/hcservices/
pending against the petitioner/A-6, out of which, three are murder cases and the offences committed by the petitioners are heinous. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.
5. Considering the previous cases pending against the petitioners, this court is not inclined to grant anticipatory bail to the petitioners.
