W.P.No.19106 of 2020 and W.M.P.No.23678 of 2020 R.N.MANJULA, J., This Writ Petition has been listed today under the caption "for being mentioned" at the instance of the learned counsel for the petitioner.

2. When the matter is taken up today, the learned counsel for the petitioner submitted that there are some clerical error in the order passed in this Writ Petition on 20.12.2023. He further submitted that in paragraph Nos. 5 & 7 of the said order, the date of retirement of service has been wrongly mentioned as 13.09.1994 & 31.03.1994 instead of 30.09.1994 and further in paragraph No.8, the order passed by the third respondent dated -.08.2014 has been omitted. Therefore, he seeks necessary modification in the order dated 20.12.2023.

3. In view of the above submission of the learned counsel for the petitioners, the order dated 20.12.2023 passed in this Writ Petition is modified to the extent indicated below:

i) In Paragraph No.5 of the said order, the date - '13.09.1994' mentioned therein shall be replaced as '30.09.1994'. ii) In Paragraph No.7 of the said order, the date - '31.03.1994' mentioned therein shall be replaced as '30.09.1994'. iii) Paragraph No.8 of the said order shall be replaced as hereunder:

" 8. Hence, the Writ Petition is allowed and the order of the first respondent dated 19.06.2012 and the consequential impugned order of the third respondent dated -.08.2014 (signed on 30.09.2014) in Na.Ka.No.3039/Aa4/2011 are set aside and the respondents are directed to extend the benefit in G.O.Ms.No.210 dated 14.08.2009 to the petitioner on parity with all other persons for whom pay fixation had been made under G.O.Ms.No.210, dated 14.08.2009, within a period of six weeks from the date of receipt of a copy of this order. No costs. Consequently, the connected miscellaneous petition is closed."

The remaining portions of the order dated 20.12.2023 remains unaltered.

21.01.2024 bkn NOTE : Registry is directed to make necessary modification in the order dated 20.12.2023 in W.P.No.19106 of 2020 and issue a fresh order copy to the parties in this Writ Petition.
