ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. 2.The present writ petition is filed praying for a writ of mandamus to direct the 2nd respondent to dispose the appeal filed by the petitioner dated 07.05.2025 before the 2nd respondent within a time frame to be fixed by this Court.
3.It is submitted by the learned counsel for petitioner that petitioner purchased a land comprised in S.No.577/1, New S.No.577/1A, measuring an extent of 23 cents, bearing Patta No.2548 situated at Devannagoundanur Village, Sankari Taluk, Salem District, from one C.Sengodan and others vide Sale Deed dated 24.03.2021, registered as Document No.1021 of 2021 before the Sub Registrar Office, Sankari. It is submitted that petitioner purchased another land comprised in S.No.577/1, New S.No.577/1A, measuring an extent of 13 cents, bearing Patta No.2548 situated at Devannagoundanur Village, Sankari Taluk, Salem District, from one C.Sengodan and others vide Sale Deed dated 15.04.2021, registered as Document No.1204 of 2021 before the Sub 2/6
Registrar Office, Sankari. Ever since purchase, petitioner has been in continuous possession and enjoyment of the above mentioned property. 4.It is submitted by the learned counsel for the petitioner that after purchase of the above mentioned properties, petitioner came to know that names of some other persons are included in the joint patta bearing Patta No.2548. It is further submitted that petitioner submitted an online application dated 20.06.2024 for sub division of petitioner's property and to issue individual patta in her name and the same was rejected by order dated 06.04.2025. Aggrieved by the same, petitioner preferred an appeal dated 07.05.2025 before the 2nd respondent and the same is pending. Aggrieved by the same, the present writ petition has been filed. 5.At the outset, learned Government Advocate for respondents would submit that they would consider and dispose of the appeal dated 07.05.2025 in accordance with law, within a time frame to be fixed by this Court.
6.In view thereof, the writ petition is disposed of with a direction to the 2nd respondent to dispose of the appeal filed by the petitioner dated 3/6
07.05.2025, after affording reasonable opportunity of hearing to the petitioner, and any other interested parties/rival claimants, if any, within a period of 12 weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the appeal and it is open to the concerned respondent to consider the same on its own merits and in accordance with law. There shall be no order as to costs.
