This writ petition is filed under Article 226 of the Constitution of India, seeking writ of mandamus directing the respondent to pay the difference amount of terminal benefits such as gratuity and earned leave salary, as per the 13th wage settlement along with 18 percent per annum interest for the belated period of terminal benefits to the petitioner. ORDER

This writ petition is filed for the following relief: "To direct the respondent to pay the difference amount of terminal benefits such as gratuity and earned leave salary, as per the 13th wage settlement along with 18 percent per annum interest for the belated period of terminal benefits to the petitioner."

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner joined the service of the respondent corporation and retired from service on 30.06.2017. Subsequently, the 13th Wage Settlement was entered into between the Management and the Trade Unions on 29.05.2023, pursuant to which the wages and pension were also revised with effect from 01.09.2016. Since the petitioner had retired on 30.06.2017, he entitled to the difference in leave salary and gratuity as per the 13th Wage Settlement. Accordingly, the petitioner submitted a representation seeking the difference in leave salary and gratuity as per the

13th Wage Settlement dated 29.05.2023. However, the said representation has not been considered so far.

In view of the above, the respondent is directed to pay the applicable differential amount of leave salary and gratuity to the petitioner, in accordance with the 13th Wage Settlement dated 29.05.2023, together with interest at the rate of 6% per annum, within a period of twelve weeks from the date of receipt of a copy of this order. 5.With the above direction, this Writ Petition stands allowed. No costs.
