Respondents Prayer: This Writ petition has been filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarifried Mandamus to call for the records relating to the impugned order of the first respondent in Na.Ka.15460/D3/2008 dated 13.05.2008 and quash the same in so far as it restricts promotion to only those who qualified before the counseling date for promotion to the post of School Assistant and direct the respondents to consider the petitioner for promotion to the post of School Assistant (Maths) in the existing vacancies in Sangagiri Block, Salem District and grant him all consequential benefits.

ORDER

2. When the matter is listed today, the learned counsel for the petitioner made a submission that the matter has become infructuous and he has also made an endorsement to the effect: "The writ petition has become infructuous and the same may be dismissed as infructuous"
3.In view of the above statement and endorsement made by the learned counsel for the petitioner, this Writ Petition is dismissed as having become infructuous.
No costs.
