The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 379 & 430 IPC and Section 21 (5) of Mines & Minerals (Development & Regulation) Act, 1957, in Crime No.212 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. It is the submission of the learned counsel for the petitioner that petitioner is an innocent and he has been falsely implicated in this case. Thus, he seeks grant of anticipatory bail for the petitioner. 3.In response, the learned Government Advocate (Crl.Side) opposed this petition and submitted that on 16.06.2023, at about 23.30 hours, when the respondent police were in their routine vehicle check up, they found a Tipper Lorry bearing registration No.TN 25 BS 6230 illegally transporting 1 1⁄2 unit of river sand without any valid permit. On seeing the police, the driver of the vehicle escaped from the spot. The vehicle and river sand are recovered.

sli 4.Considering the fact that the river sand stolen is 1 1⁄2 unit and that investigation is not completed, this Court is not inclined to grant anticipatory bail to the petitioner. Therefore, this Criminal Original Petition is dismissed.
