ORDER

(This case has been heard through video conference) This Criminal Original Petition has been filed with a prayer to transfer the investigation in Crime No.260 of 2019 from the file of the respondent police to CBCID or any other investigation agency.

2. Today, when the petition came up for hearing, there was no representation for the petitioner and the learned Additional Public Prosecutor appearing for the respondent, on instructions, would submit that in respect of the petition mentioned Crime number, the respondent has completed the investigation and filed a final report before the learned Judicial Magistrate II, Namakkal on 05.11.2019 as "undetected". In this regard, he fairly conceded before filing the final report, the respondent police have not served RCS notice to the De-facto complainant.

3. In view of the above submission made by the learned Additional Public Prosecutor appearing for the respondent, this Court directs the respondent police to serve RCS notice to the https://hcservices.ecourts.gov.in/hcservices/

de-facto complainant, within a period of two weeks from the date of receipt of a copy of this order. On such receipt, the defacto complainant is at liberty to file an appropriate application before the competent authority for any further action.

4. With the above directions, this Criminal Original Petition is disposed of.
