This application appears to have been filed by the defendants essentially to convey their urgency as to the progress of the trial. 2.The case is now under trial before the learned Additional Master No.3. The plaintiff stepped into the box as P.W.1 and it is completed. The matter is now posted for further evidence of plaintiff. Learned counsel for the plaintiff has taken out subpoena to examine one certain C.D.Johnson, the learned Advocate Commissioner as a witness. Since there was no progress, the defendants have taken out this application seeking direction of the Court to close the evidence on the side of the plaintiff. 3.Learned counsel for the plaintiff submitted that he had taken summons to the witness and the witness too had appeared before the Court but then the matter did not reach for the day.
4.Learned counsel for the defendants however submitted that his clients are senior citizens and for the same reasons the matter was sent by the learned Master before the Court.

kas 5.After weighing rival submissions, this Court required the plaintiff to take fresh summons, if so required, to the witnesses concerned and the learned Master is required to give top priority for the examination of the witnesses in this case, however in such COVID regulations in holding the Courts. 6.In view of the say, there is no need to pass any specific order in this case. 7.This application is closed accordingly.
