ORDER

The petitioner, who was arrested and remanded to judicial custody on 09.05.2026 for the alleged offences under Section 449, 366, and 506(i) of IPC and Sections 376(2), n, (f), 376(3) of IPC and Sections 5(l), (j)(ii) read with 6(1) of POCSO Act in Cr. No.8 of 2023 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner, aged 30 years, had committed aggravated penetrative sexual assault on the minor victim girl, aged 14 years, repeatedly and the victim became pregnant and hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has been remanded to judicial custody on 09.05.2026. The learned counsel would further submit that false complaint has been lodged against the petitioner and he is ready to abide by any condition that may be imposed by this Court and hence prayed to enlarge the petitioner on bail.

4. At this juncture, the learned Government Advocate (Criminal side) appearing for the respondent police has submitted the statement of the victim girl recorded under Section 183 of B.N.S.S. and would further submit that there are serious allegations against the petitioner and therefore, strongly objected to enlarge the petitioner on bail.

5. Considering the age of the petitioner is 30 years and according to the statement of the victim under Section 183 of B.N.S.S, there are serious allegations against the petitioner, this Court is of the firm view that it is not an appropriate stage to enlarge the petitioner on bail.

6. Accordingly, this Criminal Original Petition is dismissed. 12-06-2026 MJS Note:
