ORDER

This Contempt Petition has been filed to punish the respondents for willful disobedience of the orders passed by this Court in W.P.No.28871 of 2023 dated 01.08.2024.

2. The learned counsel appearing for the petitioner would submit that in W.P.No.28871 of 2023, this Court, on 01.08.2024, set aside the impugned order and directed the 7th respondent to restore the pay scale of the petitioner

and disburse the retirement benefits, such as DCRG, Special Leave, Leave encashment and other attendant benefits with interest at the rate of 6% per annum. The said order was challenged by the respondents before the Hon'ble Division Bench of this Court and the same was also dismissed in W.A.No.3830 of 2025 dated 09.1.2026, even then, the respondents have failed to comply with the order passed in the Writ Petition, hence the present contempt petition has been filed.

It is brought to the notice of this Court that the respondents 1 to 4 for the similarly placed persons as that of the petitioner in W.P.No.28871 of 2023, have challenged the order passed in W.P.(MD) Nos. 12677 to 12700 of 2024 dated 14.06.2024 before the Hon'ble Division Bench of this Court in W.A.Nos.468 of 2025 batch., and the same was allowed by order dated 29.08.2025 on the ground that even though educational qualification of Vocational Instructors cannot be compared at all to that of a B.T.Assistant Skill, a selection grade vocational instructor gets more grade pay whereas a special grade Vocational Instructor is in a far higher pay scale. For those in higher administrative grade or in pay band 4, the benefits of increment due to bunching shall be given taking into account all the stages in different pay scales in that grade. Admittedly, the vocational instructors do not fall in higher administrative grade and they are not in pay band 4. Therefore, they cannot

invoke the said Rule. In fact, following the said Judgment passed in Writ Appeal Nos.468 of 2025 etc., batch dated 29.08.2025, this Court also dismissed a batch of Writ Petitions in W.P.Nos.9201 of 2025 etc., on 17.11.2025.

It is pertinent to point out that as against the order passed by this Court in W.P.No.28871 of 2023 dated 01.08.2024, the respondents have preferred Writ Appeal in W.A.No.3830 of 2025 and the same was dismissed by Judgment dated 09.01.2026. Further, it is contention of the respondents that the respondents are in the process of filing a Review Petition before the Hon'ble Division Bench of this Court, challenging the Judgment passed in W.A.No.3830 of 2025 dated 09.01.2026.

5. In view of the above, no contempt is made out as against the respondents and the present Contempt Petition is dismissed. 10-06-2026 Index: Yes/No Speaking/Non-speaking order ssd
