Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Crl.A.No.497/2020 on the file of the High Court, the High Court will be pleased to suspend the sentence imposed on the petitioner in Spl.SC.No.30/2018 on the file of Fast Track Magalir Neethimandram (Sessions Court) Vellore pending disposal of the Crl.A.No.497/2020.

Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.A.No.497/2020 on the file of the High Court and upon hearing the arguments of M/S. G.SELVI GEORGE, Advocate for the Appellant and of M/S.R.SURYAPRAKASH, Government Advocate O/o. PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- This Petition has been filed to suspend the sentence imposed on the petitioner in Spl. S.C.No.30 of 2018 on the file of Fast Track Magalir Neethimandram (Sessions Court) Vellore, pending disposal of the Appeal.

3. Heard. Perused the records.

4. It is seen that the offence committed by the accused is grievous in nature and the learned trial Court on considering the oral and documentary evidence has convicted the accused.

5. Therefore, considering the nature of the offence and the age of the victim girl, this Court is not inclined to suspend the sentence and inclined to hear the appeal itself. https://hcservices.ecourts.gov.in/hcservices/

6. In view of the same, this Miscellaneous Petition is dismissed. Registry is directed to list the criminal appeal on 04.03.2021, for final disposal.
