This Criminal Original Petition has been filed to direct the respondent Police to secure all the accused and file charge sheet against them.
2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.
3.When the matter was taken up for hearing, learned Additional Public Prosecutor submitted that investigation in Crime No.105 of 2016 has been completed and Charge Sheet has been filed on 23.03.2018 before the Metropolitan Magistrate for CCB/CBCID Cases, Allikulam, Egmore, Chennai and the same has not been taken on file.
4.In view of the law laid down by the Supreme Court in Joginder Kumar Vs State of U.P. [1994 [4] SCC 260], this Court cannot issue a direction to the respondent Police to arrest the https://hcservices.ecourts.gov.in/hcservices/
accused. Since investigation has been completed and Charge Sheet has been filed, the prayer of the petitioner cannot be conceded.
Hence, this petition is closed.
