ORDER

The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 296(b), 115(2), 118(1), 351(3) and 309(6) of BNS, 2023 (under Section 294(b), 323, 324, 506(ii) and 394 of IPC), in Crime No.216 of 2026, seeks anticipatory bail.

2. The case of the prosecution is that, on 12.05.2026, there was a wordy quarrel between the petitioner and the defacto complainant; and that the petitioner attacked and threatened the defacto complainant, and caused injuries. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case. He is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) for the respondent submits that the investigation is not yet completed and if the petitioner is granted anticipatory bail, there is a possibility that he will tamper the witnesses and hamper the investigation. He would further submit that three similar previous cases pending against the petitioner and hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the allegations and also the bad antecedent of the petitioner and the fact that the case is in the initial stage of the investigation and that the custodial interrogation of the petitioner is essential, this Court is not inclined to grant anticipatory bail to the petitioner.
