ORDER
This Criminal Original Petition has been filed challenging the summons issued by the respondent police dated 04.07.2023.
2.Learned Additional Public Prosecutor, on instructions, submitted that, based on the complaint given by the defacto complainant, petition enquiry is pending in C.No.300/DCB/PLR/2023 on the file of the respondent Police. Hence, the petitioner is required for enquiry.

ssr 3.The petitioner is directed to co-operate with the Police for enquiry and the respondent Police shall conduct the enquiry keeping in mind the judgment in Lalitha Kumari vs. Government of Uttar Pradesh reported in 2013 (6) CTC 353. On completion of the enquiry, the respondent Police shall take a decision regarding the further course of action.
