C.E.PRATAP, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 403, 406, 419 and 420 of IPC in Crime No.879 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner was working in the defacto complainant's company. By using the defacto complainant online, the petitioner along with his friends and brother, ordered valuable things and thereafter, replaced the products with dummy things. Hence, the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as stated by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate submitted that the subject properties were not recovered from the petitioner and investigation is still pending and hence, he objected to grant anticipatory bail to the petitioner.

5. Considering the serious allegation levelled against the petitioner and the subject properties were not recovered, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this petition is dismissed.
