This application has been filed seeking to condone the delay of 139 days in filing the written statement.
2. The plaintiff had instituted the suit seeking recovery of money.
3. In the affidavit filed to explain the delay, it had been stated that the defendant was not able to confirm whether the suit summon was actually served or not and therefore, the counsel did not entered appearance. Thereafter, the defendant had actually been set ex-parte. Then the learned counsel was engaged and after examining the records, written statement has now been filed. The Ex-parte order was already set aside.
4. In view of the fact, that it would only be appropriate that the pleadings of the party are taken on record and the parties are given an opportunity to explain their respective stands during the course of trial, the delay is condoned.
5. The application stands allowed. The written statement is taken on record.
