M/S.India Tourism Development v. Ms.M.R.Junaitha Begum

2019-08-01Honourable Mr Justice R. Subramanian2 pages

A.No.5366 of 2019 in C.S.No.553 of 2017 R.SUBRAMANIAN, J., This application has been filed seeking to condone the delay of 655 days in filing the written statement.

2. The suit is one for recovery of difference between the fair rent and the agreed rent. It is stated that the Civil Revision Petition filed by the defendant challenging the order of fixation of fair rent is pending and the delay was caused due to the pendency of the Civil Revision Petition.

3. In view of the same, I am of the considered opinion that the defendant deserves a chance to defend the suit on merits. Hence, the delay is condoned and the written statement is taken on file.

4. The Registry is directed to post the suit "for framing issues" on 13.08.2019.
