O R D E R

This Contempt Petition has been filed seeking to punish the respondent for committing wilful disobedience of the order dated 16.08.2021 passed in Crl.R.C.No.1122 of 2014 by this Court, under the Contempt of Courts Act. 2.

By order dated 16.08.2021 in Crl.R.C.No.1122 of 2014, this Court Page No.1 of 4

directed the petitioner/husband to make necessary arrangements to provide shelter to the respondent/wife within a period of three months from the date of receipt of a copy of that order. However, the petitioner/husband has filed contempt petition before this Court, on the ground that the respondent/wife has not vacate the premises as directed by this Court. 3.

Learned counsel for the petitioner submitted that, in order to prove the compliance with the order of this Court, a memo was placed before the Family Court.

However, the memo is not conclusive proof. Unless the petitioner produces before this Court material evidence such as proof of payment of advance amount to the landlord and a valid rental agreement, the contempt is not made out against the respondent.

In the absence of any proof showing that arrangements were made to provide shelter to the respondent, the contempt does not arise. Therefore, the Contempt Petition itself is not maintainable, and it is held that there is no wilfull disobedience on the part of the respondent to the order of this Court. Page No.2 of 4
