The petitioner, who apprehends arrest at the hands of the respondents police for alleged offences punishable under Sections 377, 376-D, 420, 506, 354, 511, 120-B and 34 IPC, in Crime No.0772 of 2022, on the file of the first respondent police, seeks interstate anticipatory bail.
2. The case of the prosecution is that the defacto complainant is working in the office of Shri Shaikh Hamdan Bin Ahmed A1 Makloom, Dubai. While that being so, the petitioner introduced the defacto complainant with one Manish as Corporate Relationship Officer of famous magazine. Thereafter, both were met her and used to join dinner on various occasions as friends. The further allegation is that petitioner along with other accused had sexual intercourse with the defacto complainant on many occasions, without her will and threatened her to have sexual intercourse with them. Hence the complaint.
3. The learned counsel for the petitioner would submit that false complaint has been given against the petitioner and he has nothing to do with the said allegations. He further submitted that Interstate Anticipatory bail may be granted to him to enable him to move the appropriate jurisdictional Court in Mumbai, for necessary relief.
4. Taking into consideration the facts and circumstances of the case, this Court is inclined to grant inter-state interim anticipatory bail to the petitioner for a period of six weeks from today to enable him to move the concerned Court.
5. Accordingly, interim interstate anticipatory bail is granted to the petitioner for a period of six weeks, on condition that the petitioner shall surrender before the learned Judicial Magistrate, Alandur, within a period of fifteen days from the date on which the order copy made ready and the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the said learned Magistrate. Further, within four weeks from the date of execution of bail bond, the petitioner shall approach the competent Court in Mumbai, and seek appropriate relief.
