This petition has been filed to modify the order passed by this Court on an earlier occasion in Crl.R.C.No.851 of 2022, in and by which this Court had directed for return of vehicle on condition to submit a bond for a sum of Rs.4,00,000/- and also to produce one surety for another sum of Rs.4,00,000/-.

2. Learned counsel for the petitioner would submit when the matter was taken up for hearing, by oversight the facts were not properly brought to the notice of this Court. Therefore, he would now submit that the petitioner himself is a victim in this case and he does not have any property worth a sum of Rs.8,00,000/-, so as to produce as security as ordered by this Court.

3. This Court considered the said submission made by the learned counsel for the petitioner and perused the First Information Report. D.BHARATHA CHAKRAVARTHY, J.

4. Learned Government Advocate (Crl. Side) would also confirm that the petitioner is also a victim in this case.

5. In that view of the matter, this Criminal Miscellaneous Petition is ordered and the condition imposed by this Court by an order dated 05.07.2022 in Crl.R.C.No.851 of 2022 directing the petitioner to submit a bond for a sum of Rs.4,00,000/- and also to produce one surety for a sum of Rs.4,00,000/- shall stand deleted and in other respects, the order of the Judicial Magistrate, Thiruvarur is confirmed. 01.09.2022 rgi Crl.M.P.No.13613 of 2022 in Crl.R.C.No.851 of 2022 https://www.mhc.tn.gov.in/judis
