ORDER

This petition is filed to direct the respondent to file the final report in Crime No.407 of 2023 as per the direction issued by this Court on 11.09.2024 in Crl.O.P.No.22413 of 2024 within the time period that may be fixed by this Court. 1 / 5

2. This Court, while disposing of Crl.O.P.No.22413 of 2024 on 11.09.2024, gave a direction to the respondent-Police to complete the investigation and file final report within a period of four months.

3. The respondent-Police had not complied with the above direction of this Court within the stipulated time and kept the matter pending for a long time and hence, once again, the petitioner has filed the present miscellaneous petition for further direction in that regard. It is to be noted that the respondent-Police has failed to comply with the direction of this Court made in the said Crl.O.P. on 11.09.2024.

4. The learned Government Advocate appearing for the respondent submitted that, pending the present petition, the Police had filed final report/charge-sheet before the Court.

It is seen from the records that, this Court, while disposing of Crl.O.P.No.22413 of 2024, gave a specific direction on 11.09.2024 for filing final report within four months, whereas, the respondent-Police neither complied with the direction, nor sought extension of time, nor gave intimation to the concerned, to seek extension, but simply kept the matter quiet for more than six 2 / 5

months and now the present miscellaneous petition is filed by the de-facto complainant for the above direction to file the charge-sheet/final report.

Hence, the Director General of Police, Santhome, Chennai, is directed to issue internal circular to all the investigating officers in the State of Tamil Nadu that if the Court gives any specific direction for complying with any order within the stipulated time therein, the investigating officers, should either comply with the order in a case or inform the Court that they are unable to comply with the condition that is being imposed by the Court or seek extension of time through the Government Pleader/Public Prosecutor with regard to the non-compliance of any order. If any investigating officer fails to comply with the order of the Court, or fails to take suitable steps to get extension of time, the concerned authority shall direct the superior officers to take action against those erring officers who disobeys the direction/order of this Court.

7. With the above observations and directions, this miscellaneous petition is closed.
