ORDER

Since no adverse Order is passed against the fifth respondent, notice to him is dispensed with. With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This Writ Petition is filed to direct the third respondent to consider the representation of the petitioner dated 20.03.2024 and cancel the settlement deed which was given to her son on 06.06.2014 in Document No.3845/2014 in Survey No.205/3 on the file of the fourth respondent.

3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents 1, 2 and 4 and the learned Government Advocate appearing for the third respondent and perused the materials available on record.

4. The case of the petitioner is that she had executed a settlement deed in favour of her son on 06.06.2014. According to the petitioner, after the settlement, she has not been maintained properly. Hence, the present Writ Petition to cancel the settlement deed executed in favour of her son. Hence, the present Writ Petition.

5. I have perused the settlement deed dated 06.06.2024. The settlement is absolute and there is no power of revocation. Further, the settlement is not in lieu of any maintenance. Merely on the basis of a representation, the settlement deed which has already been executed, cannot be revoked. It is for the petitioner to seek remedy before the competent Civil Court. Hence, I do not find any merits in this Writ Petition.
