ORDER
This criminal miscellaneous petition has been filed by the defacto complainant/ petitioner, to cancel the bail granted to the second respondent herein by this Court in Crl.O.P.No.9633 of 2025 dated 02.04.2025. 2.
The learned counsel appearing for the petitioner/ defacto complainant submitted that the accused/ 2nd respondent herein was granted bail by this Court, vide order dated 02.04.2025 in Crl.O.P.No.9633 of 2025 with one of the conditions that the petitioner shall deposit a sum of Rs.3,00,000/- to the credit of Crime No.58 of 2025 before the learned Magistrate concerned within a period of four weeks from the date of receipt of copy of this order and on such deposit, the defacto complainant is permitted to withdraw the same; that however, the accused had not complied with the said condition, hence prays to cancel the bail granted to the second respondent/ accused. 3.
Though notice was served on the second respondent, there is no representation on his behalf and he also not appeared before this Court. 4.
Heard the learned Government Advocate (Crl. Side) appearing for 2/4
the first respondent.

Considering the aforesaid facts and circumstances, since the accused/ second respondent had not complied with the condition of deposit of Rs.3,00,000/- as imposed on him by this Court, vide order dated 02.04.2025 in Crl.O.P.No.9633 of 2025, I am of the view that the bail granted to the accused/ second respondent herein is hereby cancelled. 6.
Accordingly, this criminal original petition is allowed. 06.11.2025 stn To
