Crl.O.P.No.16217 of 2023 G.CHANDRASEKHARAN.J., The petitioners namely P.Sasikumar, M.Dinesh Kumar, S.Hariharan, S.Dinesh Kumar and Manikandan, who were arrested and remanded to Judicial Custody on 02.07.2023 for the offences punishable under Sections 294(b), 147, 148, 448, 323, 324 & 506(ii) of IPC and 3(1) of TNPPDL Act and subsequently altered into Sections 147, 148, 448, 294(b), 323, 324, 307, 506(ii) of IPC read with Section 3 (1) of TNPPDL Act in Crime No.199 of 2023 on the file of the respondent police seeks bail.

2. The learned counsel for the petitioners submitted that, petitioners are innocent persons and they have been falsely implicated in this case. Petitioners are in Judicial Custody from 02.07.2023. Thus, he seeks bail to the petitioners.

3. The learned Government Advocate (Crl. Side) submitted that, petitioners along with other accused visited Tasmac situated at 1/4

Settipalayam opposite to CD Foundation at about 11.00.p.m., on 01.07.2023 and demanded Brandy. It was informed them that the shop was closed. Enraged at this, they threatened the defacto complainant and left the place. On the next day ie., on 02.07.2023, at about 02.00.a.m., accused trespassed into the defacto complainant's room, abused the defacto complainant and others in filthy language and damaged the articles using wooden log, beer bottle and upvc frame and also attacked them. 4. Considering the gravity of the offence committed by the accused and the nature of injuries suffered by the injured in the alleged incident and also the fact that investigation in this case is not completed, this Court is not inclined to grant bail to the petitioners. 2/4
