Prayer in CRP No.2548 of 2004: Civil Revision Petition filed under Section 115 of C.P.C., to call for records in I.A.No.13095 of 2003 in O.S.No.2152 of 2003 on the file of the XIV Asst. City Civil Judge, Chennai, order dated 12.01.2004 and set aside the same by allowing the Civil Revision Petition by granting unconditional leave to the petitioner to defend the suit.

Prayer in CRP No.2581 of 2004: Civil Revision Petition filed under Section 115 of C.P.C., to call for records in I.A.No.13096 of 2003 in O.S.No.2153 of 2003 on the file of the XIV Asst. City Civil Judge, Chennai, order dated 12.01.2004 and set aside the same by allowing the Civil Revision Petition by granting unconditional leave to the petitioner to defend the suit.

COMMON ORDER CRP Nos.2548 and 2541 of 2004 both the CRPs have been filed against the dismissal of the leave to defend application by the XIV Asst. City Civil Judge, Chennai by a separate order dated 12.01.2004, passed in OS No.2152 of 2003 and OS No.2153 of 2003. The petitioner in both the CRPs are one and the same. Hence, both the CRPs are disposed by a common order. 2.Today the matter is listed under the caption "for dismissal" and there is no appearance on both sides. On 09.01.2018, when the matter was listed, the learned Counsel for the petitioner sought for an adjournment on the ground that there is a possibility of settlement. Thereafter, on 09.02.2018, when the matter was listed there was no appearance on both sides.

3.This Court directed the Registry to list the matter under the caption "for dismissal" on the next Single Sitting date. On 15.02.2018, when the matter was listed for hearing, the learned Counsel for the petitioner once again sought further time to report settlement of the matter. At request of the learned Counsel for the petitioner, the matter was adjourned.

4.Today, the instant Civil Revision Petitions are listed under the caption "for reporting settlement". The matter was called at 11.15 A.M. and since there was no representation on both sides it was passed over. Once again when the matter was called at 12.35 P.M., there was no representation on both sides. 5.Accordingly, both the Civil Revision Petitions are dismissed for non-prosecution. Consequently, connected miscellaneous petitions are closed.
