This writ petition is filed under Article 226 of the Constitution of India, seeking writ of mandamus directing the 1st respondent to step up the salary of the petitioner on par with that of his junior by applying Rule 5 of the Tamil Nadu Revised Scales of Pay Rules, 2009 and Fundamental Rule 22 B(2) at Rs.64,600/- in Level 18, Cell No.20, in the scale of pay Rs.36,900 -1,16,600/- after that 6th Pay Commission and Rs.74900/- Level 18 Cell 25 in the scale of pay Rs.36900-1,16,600 and following the orders of this Court dated 25.04.2022 in W.P. No.573 of 2015 and W.P.No.11744 of 2023 dated 21.08.2024.

Mr. A.R.Balaji Government Advocate Order This writ petition is filed for the following relief: "To direct the 1st respondent to step up the salary of the petitioner on par with that of his junior by applying Rule 5 of the Tamil Nadu Revised Scales of Pay Rules, 2009 and Fundamental Rule 22 B(2) at Rs.64,600/- in Level 18, Cell No.20, in the scale of pay Rs.36,900 -1,16,600/- after that 6th Pay Commission and Rs.74900/- Level 18 Cell 25 in the scale of pay Rs.36900-1,16,600 and following the orders of this Court dated 25.04.2022 in W.P. No.573 of 2015 and W.P.No.11744 of 2023 dated 21.08.2024."

2. The Petitioner was appointed as B.T. Assistant in Government Higher Secondary School, Reddiyur, Cuddalore District on 28.07.2004, on a consolidated pay and his service was regularized from 01.06.2006 and the pay of the Petitioner was fixed as Rs.14830 in the pay scale of

Rs.9300-34800+GP4600.

3. The petitioner would submit that on 19.11.2011 was promoted as PG Assistant in the GHSS, Thozhudur, Cuddalore District and on the same date he was regularized in the post of PG Assistant and the pay of the petitioner was fixed as Rs.19590 in the scale of pay of Rs.930034800+GP4800.

The petitioner would submit that one Mr.R.C.Velusamy was appointed as B.T.Assistant in the Government Higher Secondary School, Vittampalayam, Namakkal District on 16.06.2006, his service was regularized on 16.06.2006 and his pay was fixed as Rs.14830 in the pay scale of 9300-34800+GP4600. The said Velusamy was moved to B.T. Assistant Selection Grade on 16.06.2016 and his pay was fixed as Rs.23,830 in the pay scale of 9300-34800+GP4600. On 23.08.2016, the said Velusamy was promoted as PG Assistant (Chemistry) in the same school. On the same date, his service was regularized and his pay was fixed at Rs.24750 in the pay scale of Rs.9300-34800+GP4800.

5. The grievance of the petitioner is that said R.C.Velusamy is receiving higher salary than the petitioner. Therefore, the petitioner sent a representation dated 17.04.2024, to the Joint Director of School Education, through proper channel to rectify the pay anomaly. Aggrieved by the inaction on the part of the respondents, the petitioner is before this court for the aforesaid relief.

6. Heard the learned counsels on the either side and perused the records.

7. This Court in a similar case in WP.No.11744 of 2023 had held as follows:

"9. In the light of the above discussion, the impugned proceedings of the third respondent in O.Mu.No.053712/L/E3/2022, dated 30.09.2022 and the consequential order of the fourth respondent in Na.Ka.No.04579/A2/2022, dated 06.12.2022, are hereby set aside.

10. There shall be a direction to the respondents 3 and 4 to pass necessary orders by stepping up the pay of the

petitioner on par with that of the sixth respondent with all consequential benefits. This exercise shall be completed within a period of eight (8) weeks from the date of receipt of a copy of this order.

In the result, this writ petition is allowed with the above direction. No costs. Consequently, connected miscellaneous petition is closed."

Considering the facts and circumstances of the case and in view of the above order, the respondents are directed to consider the petitioner's representation dated 17.04.2024 and pass orders, in tune with the earlier order of this Court in WP.No.11744 of 2023, within a period of 8 weeks from the date of receipt of a copy of this order.

9. With the above direction, this writ petition is disposed of. No costs.
