This writ petition has been filed seeking a Writ of Mandamus, directing the respondents 1 to 3 herein to provide appropriate and adequate police protection to the petitioner's LPG showroom "Saravana Bharat Gas Agency" for smooth completion and commissioning the operations in the land measuring an extent of 19.93 cents in Paimash No.126-D of Komarapalayam Agraharam Village, Tiruchengode Taluk, Namakkal District, by taking suitable action against the 4th respondent and her men and forbear them from trespassing and indulging in any unlawful activities in the showroom.
2. Today, Mr.P.Marimuthu, HC 965, Kumarapalayam Police Station, Namakkal District, is present before this Court.
3. It is the case of the petitioner that he has taken the premises of the fourth respondent on lease for running a Gas Agency viz., "Saravana Bharat Gas Agency". However, after having entered into the registered lease deed dated 17.10.2013 for 17 years, the fourth respondent attempted to later forcible possession of the leased premises. In this regard, on the complaint given by one Thangavel, who is the father of the petitioner, a case in Komarapalayam P.S. Crime No.283 of 2018 for the offences under Sections 147, 294-B, 323, 427 and 506(ii) IPC, has been registered on 09.05.2018 against the fourth respondent and others and the investigation is pending. While so, the petitioner is before this Court seeking police protection.
4. It is also seen that the fourth respondent has filed a suit in O.S.No.114 of 2018 against the petitioner and the same is pending on the file of the Principal District Munsif Court, Tiruchengode. No interim injunction has been granted.
5. On instructions, the learned Additional Government Pleader submitted that, as of now, there is no law and order problem and that the police have also keep watching the said premises, by putting a Patta Book.
6. In view of the above, this Court directs the respondent police to ensure that there is no law and order problem in the premises.
With the above direction, this petition is closed. No costs. Consequently, connected miscellaneous petitions are closed.
